ACTA respects the privacy of the people we deal with and is required by law to comply with the Privacy Act 1988 (Cth) (the Act), including the Australian Privacy Principles.  This policy explains how we handle personal information.  In particular, the policy sets out:

What information we collect

The information that we collect will usually be “personal information,” ie your name, address, and contact details (email address, mobile phone number etc.).  In some instances, we may need to collect “sensitive information” about you, if it is relevant to the product we are providing to you.

Why we need to collect personal information

We collect personal information about you to provide you with quality products /services /transaction opportunities. We need to maintain your current contact details to provide you with periodic reporting on the status of your investments.

We are required to ensure that our legal obligations are adhered to, which may include anti-money laundering and counter-terrorism financing requirements.

How we collect personal information

We collect personal information directly from you – this may be in person (from documents you give to us), information you have uploaded onto our website, or via phone calls or emails.

We may also collect your personal information from your personal advisers, accountants, and other information service providers (eg financial crime information exchanges) as part of our Know Your Customer / Client Due Diligence requirements.

How we use your personal information

We use your personal information for the purpose you provided it to us, which may include:

  1. Enquiring about our products or services
  2. Processing your application
  3. Establishing you as a client
  4. To provide periodic communication to you, including investment activities

How we store your personal information

Personal information is stored in electronic records, which may be stored in the cloud.  The confidentiality and security of the information is paramount.  This includes following our internal policies and procedures to ensure security and confidentiality of data, and access to data.

Where external organisations provide support services to ACTA, we require them to have appropriate technical and organisational processes to ensure the privacy of the ACTA information they hold.

We also keep records of our interactions with you, via email and online.  These records are securely maintained for the statutory periods.

How you can access or correct your personal information

You can contact us if any of your contact details have changed, or if you feel that some of your personal information is incorrect, so that we may update our records.

You are entitled to request access to the personal information we hold about you, subject to completion of our verification processes and to any access restrictions that are imposed or permitted by law.

How you can ask questions or make a complaint

If you have any questions or complaints regarding privacy, please contact us by phone or email. Please mark communications for the attention of our Privacy Officer. We will respond to let you know who will be handling your matter and when you can expect a further response.

If your concerns are not resolved to your satisfaction, you may be able to escalate your complaint to an external dispute resolution scheme or to a regulatory authority.
